Return Period (Right of Withdrawal) How Many Days?

The BUYER has the right to withdraw from the distance sales contracts regarding the sale of goods within fourteen days from the date of delivery of the goods to themselves or to the person/organization at the address specified, without assuming any legal or penal liability and without stating any reason. For distance contracts regarding the provision of services, this period begins from the date of signing the contract. If it is agreed in the contract that the service will be performed before the fourteen-day period expires, the consumer can use the right of withdrawal until the date the service begins. The costs arising from the exercise of the right of withdrawal are borne by the SELLER.

To exercise the right of withdrawal, the BUYER must notify the SELLER by fax, phone, or email within the fourteen-day period, and the goods/services must be in accordance with the provisions of Article 4 of the Distance Sales Agreement and the preliminary information published on www.hukukfuar.com, meaning that the packaging and contents must be undamaged and suitable for resale. The procedures for returns within the scope of the right of withdrawal are included in the Distance Sales Agreement. In this case, the original invoice related to the goods/services delivered to the third party or the BUYER must be returned. Within a maximum of 14 (fourteen) days following the receipt of the withdrawal notification, the price of the goods/services and the delivery costs will be refunded to the BUYER, and the BUYER is obliged to return the goods/services within 10 (ten) days. If the original invoice is not sent, the VAT and any other legal obligations cannot be refunded to the BUYER.

If the value of the goods decreases due to the BUYER’s fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER for the damages caused by their fault. Payments can be made using credit card, EFT, or wire transfer methods.

Products for Which the Right of Withdrawal Cannot Be Exercised

The products/services that cannot be returned due to their nature include perishable goods, goods that may expire, single-use products, and any software and programs that can be copied. Furthermore, for all types of software and programs, DVDs, DIVXs, VCDs, CDs, MDs, videotapes, computer consumables (toners, cartridges, ribbons, etc.), and cosmetic products, the product/service must be unopened, undamaged, and unused for the right of withdrawal to be exercised.

a) Contracts for goods or services whose prices fluctuate due to changes in financial markets and are not under the control of the seller or provider.
b) Contracts for goods prepared according to the consumer’s requests or personal needs.
c) Contracts for the delivery of perishable goods or goods that may expire.
ç) Contracts for goods whose protective elements such as packaging, tape, seals, or packages have been opened after delivery, where the return is not suitable for health and hygiene reasons.
d) Contracts for goods that mix with other products after delivery and cannot be separated by their nature.
e) Contracts for books, digital content, and computer consumables presented in physical form, whose protective elements have been opened after delivery.
f) Contracts for the delivery of periodicals such as newspapers and magazines, except those provided under subscription contracts.
g) Contracts for accommodations, moving goods, car rentals, food and beverage supplies, and leisure activities that must be performed on a specific date or period.
ğ) Contracts for services performed immediately in electronic environments or intangible goods delivered immediately to the consumer.
h) Contracts for services that have commenced with the consumer’s consent before the withdrawal period expires.

How to Return?

Before sending the product back to us, you must notify us of your return request by filling out the product return form on this page. After our technical department sends you the return approval, please fill out the return form that comes with the package and send the product to us with a reliable shipping company. The approval information will be communicated to you via phone or email. The shipping costs for returns will be borne by the sender. Returns with postage due will not be accepted. If the returned products meet the return conditions, the refund will be processed on the day the product arrives at our location. The originality, hygiene, and resellability of the product must be maintained. Therefore, we cannot accept returns of products with damaged packaging, opened packaging, used, or destroyed. In case of return, we kindly ask you to specify the reason for the return.
